Just <a href=\"https:\/\/first100years.org.uk\/a-woman-is-not-a-person-a-review-of-bebb-v-the-law-society-1914\/\" target=\"_blank\" rel=\"noopener\">100 years ago<\/a>, women were ruled \u201cnot people,\u201d and refused the right to the Law Society entrance exams.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>After two world wars, decades of relentless suffrage, glacial policy changes, game-changing birth control innovations, and countless setbacks, it was by the 1970s that over 50% of Western women were engaged in <a href=\"https:\/\/www.ons.gov.uk\/employmentandlabourmarket\/peopleinwork\/employmentandemployeetypes\/timeseries\/lf25\/lms\" target=\"_blank\" rel=\"noopener\">continuous paid work<\/a>\u2014compared to virtually all men and dads.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>The road for working parents (and in particular mothers) remains uphill, with unfair treatment and unjustified perceptions consistently blocking their ambitions.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>We\u2019re going to take a look at how the treatment of working parents has changed over the years and, crucially, what steps are yet to be taken.<\/p>\n<div class=\"div-spacer\"><\/div>\n<h2>Provisions for Working Parents<\/h2>\n<p><strong>Childcare &amp; Nurseries<\/strong><\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>The argument for Federal, state, or local childcare first hit the headlines in the 1970s. Back then\u2014despite more women actively working than ever before\u2014government decision makers still saw \u201cchildcare [as] the mother\u2019s domain.\u201d If a mother was to work, it was her choice to put her familial responsibilities to one side.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p><a href=\"https:\/\/www.historyextra.com\/period\/modern\/working-mothers-history-motherhood\/\" target=\"_blank\" rel=\"noopener\">Or as one local health official put it<\/a>: \u201cIf the career mother wishes to park out her child for a substantial proportion of the day\u2026 she should at least be asked to pay the full cost, and should not expect the state or the municipality to subsidize her.\u201d<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>Thankfully, the women of the 1970s and 80s didn\u2019t take this argument lying down. Feminists, trade unions, and childcare experts were adamant that nurseries should not only be a social priority for ending sex discrimination and unequal opportunities, but also for the greater <a href=\"https:\/\/www.americanprogress.org\/article\/growing-economy-affordable-child-care\/\" target=\"_blank\" rel=\"noopener\">economic prosperity of the nation<\/a>.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>While some childcare policies were introduced and a great number of daycares have since opened across the country, it remains woefully underfunded. The result is a childcare system that is wildly unaffordable for all but the highest percentile of earners in the US.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>On paper, moms can now have it all: full-time careers and childcare during those working hours. But in reality, many mothers are forced to choose between working to pay for childcare, or dropping their work entirely\u2014with very little economic difference between the two scenarios.<\/p>\n<div class=\"div-spacer\"><\/div>\n<p><a href=\"https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-scaled.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-56016\" src=\"https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-scaled.jpg\" alt=\"\" width=\"2560\" height=\"1707\" srcset=\"https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-scaled.jpg 2560w, https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-300x200.jpg 300w, https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-1024x683.jpg 1024w, https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-768x512.jpg 768w, https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-1536x1024.jpg 1536w, https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-2048x1365.jpg 2048w, https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-600x400.jpg 600w, https:\/\/www.sogolytics.com\/blog\/wp-content\/uploads\/2022\/12\/edward-cisneros-5EnPNw_9xSc-unsplash-50x33.jpg 50w\" sizes=\"(max-width: 2560px) 100vw, 2560px\" \/><\/a><\/p>\n<div class=\"div-spacer\"><\/div>\n<p>Today, childcare remains one of the great unfulfilled promises of modern America.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p><strong>Job Security and Opportunities<\/strong><\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>Having children remains <a href=\"https:\/\/www.nytimes.com\/2014\/09\/07\/upshot\/a-child-helps-your-career-if-youre-a-man.html\" target=\"_blank\" rel=\"noopener\">statistically the worst career decision<\/a> a woman can make.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>Not only is there an epidemic of casual stigma against the commitment of \u201cattention-divided\u201d moms, but childless women are <a href=\"https:\/\/gap.hks.harvard.edu\/getting-job-there-motherhood-penalty\" target=\"_blank\" rel=\"noopener\">8.2 times more likely<\/a> to be recommended for a promotion than mothers.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>The fear of being removed\u2014directly or indirectly\u2014from their responsibilities is one of the biggest fears that new moms have before giving birth: some <a href=\"https:\/\/www.linkedin.com\/pulse\/nearly-half-mothers-work-take-break-again-why-still-stigma-fairchild\/\" target=\"_blank\" rel=\"noopener\">35% of working parents<\/a> who did not take a career break, but would have liked to, cited a fear of losing their job.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>While it is illegal to discriminate against parents in this way, a <a href=\"https:\/\/womenemployed.org\/our-accomplishments\/1980s\/\" target=\"_blank\" rel=\"noopener\">$14 million settlement<\/a> in the 1980s shows it was happening then, and with <a href=\"https:\/\/www.peoplemanagement.co.uk\/article\/1747027\/women-less-likely-to-be-promoted-after-having-children\" target=\"_blank\" rel=\"noopener\">half as many moms still getting promoted<\/a> as dads today, it\u2019s clearly still a prevalent and frightening problem today.<\/p>\n<div class=\"div-spacer\"><\/div>\n<h2>Expectations on Working Moms and Dads<\/h2>\n<p><strong>Time Off Work for Birth or Adoption<\/strong><\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>When the federal <a href=\"https:\/\/www.nccp.org\/publication\/paid-leave-in-the-states\/#:~:text=The%20Policy%20Context%20at%20the%20Federal%20Level&amp;text=Under%20FMLA%2C%20covered%20and%20eligible,foster%20placement%20of%20a%20child.\" target=\"_blank\" rel=\"noopener\">Family and Medical Leave Act (FMLA)<\/a> was signed into law in 1994, it seemed like a huge step forward: up to 12 weeks a year of leave in order to care for a new child, adopted or born!<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>But it was also unpaid, and many parents (and overwhelmingly fathers) were discouraged from leveraging the policy. The loss of wages makes it impossible for most low-income families to utilize this time off and barely half of working parents actually qualify in the first place.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>In terms of parental leave, the US is tragically behind <a href=\"https:\/\/www.sogolytics.com\/blog\/how-companies-can-support-new-dads\/\" target=\"_blank\" rel=\"noopener\">almost all of the developed world<\/a>. Despite more than <a href=\"https:\/\/osf.io\/preprints\/socarxiv\/hd4ct\/\" target=\"_blank\" rel=\"noopener\">80% of Americans<\/a> backing paid parental leave, financial pressure regularly forces parents to return to work after barely a few weeks with their child. And without grandparents or strong neighborhood support, they\u2019ll be paying through the nose for childcare too.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p><strong>Work Commitment\u2014Or the Lack Thereof<\/strong><\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>One of the biggest problems faced by working moms (and more recently, dads) is the total disregard for their ambition, competence, and loyalty to the job\u2014a problem that\u2019s festered since women first joined the labor force en masse more than 60 years ago.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>To this day, mothers are considered <a href=\"https:\/\/gap.hks.harvard.edu\/getting-job-there-motherhood-penalty\" target=\"_blank\" rel=\"noopener\">12% less committed<\/a> to work than non-mothers. This perception masks a deeper problem that many employers consider their employees\u2019 attention and focus to be their own property.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>The idea that we all have \u201cother things\u201d to focus on, away from work, should not be controversial\u2014and yet many white collar careers penalize \u201ctime off\u201d and glorify burning the midnight oil (think law or finance workers). Yet parents simply cannot do this without full-time childcare or being forced to neglect their kids.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>But the problem extends far beyond the upper middle class and, predictably, affects minorities more. <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/discrimination-against-working-mothers-must-end\" target=\"_blank\" rel=\"noopener\">One in two women of color<\/a> report that their commitment or competence was questioned after they had kids.<\/p>\n<div class=\"div-spacer\"><\/div>\n<h2>Discrimination: The Law vs Reality<\/h2>\n<p>Back in the 1980s, <a href=\"https:\/\/www.pewresearch.org\/social-trends\/2009\/10\/01\/the-harried-life-of-the-working-mother\/\" target=\"_blank\" rel=\"noopener\">30% of Americans<\/a> said women should return to their \u201ctraditional roles\u201d in society. In 2009, still 19% believed that women should return to their traditional roles as domestic wives and non-workers. Only 15% strongly agreed that both spouses should contribute to the household income.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>While there is <a href=\"https:\/\/www.eeoc.gov\/laws\/guidance\/enforcement-guidance-unlawful-disparate-treatment-workers-caregiving-responsibilities\" target=\"_blank\" rel=\"noopener\">extensive legal protection<\/a> for moms and parents, does it actually make a difference?<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>It is sex discrimination to deny a father\u2019s request for paternity leave (and other requests related to child-rearing), and yet the pressure applied to fathers to remain at work remains extremely high. Threats of hindered career progression are widespread.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>But many working parents are fighting back. <a href=\"https:\/\/hbr.org\/2012\/09\/will-working-mothers-take-your-company-to-court\" target=\"_blank\" rel=\"noopener\">According to data collected by the Center for WorkLife Law<\/a>, in the United States, roughly two-thirds of plaintiffs who sue in federal court on the basis of family responsibilities discrimination win at trial\u2014twice the success rate of more general employment discrimination cases.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>In 2007, a female delivery driver won $2.3 million after her employer, Bimbo Bakeries, decided her pregnancy made her unqualified to do her job and refused to find her another position within the company\u2014an utterly baseless decision.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>This type of discrimination has been <em>illegal since 1984<\/em>\u2014and yet it remains rife across most industries. With most people unable to wage legal battle against their employers, it\u2019s easy to see how such discrimination could remain unchecked.<\/p>\n<div class=\"div-spacer\"><\/div>\n<h2>What Does the Future Hold for Parents at Work?<\/h2>\n<p>Over the past several decades, the general treatment of working parents (and the broad acceptance that careers and parenting can coexist) has improved, but remains far from perfect.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>Childcare is available and widely utilized, but only by those who can afford it. The lack of government funded childcare hits minorities, low-earners, and single parents extremely hard. Parents are still perceived to be \u201cless committed\u201d at work, but it\u2019s trending in the right direction. The idea that workers are allowed lives outside of work has gained traction since the COVID-19 lockdowns.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>If we look at the marginalization of working mums 60 years ago, most of us are appalled. And yet the unaffected majority (most men and some \u201ccareer women\u201d of that era) couldn\u2019t see it happening. Today, we have a responsibility to be more aware than previous generations and realize that there is much work to be done.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p>The treatment of working parents isn\u2019t going to transform overnight. But if this upwards trajectory continues, and those most desperate for help start to receive it, then perhaps for the next generation the transformation will be complete.<\/p>\n<div class=\"div-minispacer\"><\/div>\n<p><em>From your perspective, does your organization treat parents and child-free workers equally?
